One of the region’s the firm accounting firms is going to get its the firm in court after all.

The Appellate Division of mitchel musso New York Supreme Court has overturned a dismissal of a case filed by Weiser LLP against three the firm partners in the firm.

Weiser charged that the three ex-partners, Jeffrey Coopersmith, William Vogel, and Michael Simon, left Weiser to start a new firm, Coopersmith, Simon & Vogel, in Uniondale, taking a group of Weiser’s clients with them without paying the agreed-upon fee for doing so.

The three partners had merged their previous Long Island firm, Lopez, Edwards, Frank & Co., with Weiser in 1998.

They had signed a partnership agreement, which required them, in the event they left the company, to pay for assets they took with them.

The Supreme Court of New York County had previously ruled in favor of the former partners.

Douglas Phillips, Weiser’s Chairman stated: “We are very pleased that this respected New York court has unanimously decided that, when partners make an agreement, they must live by its terms. Our partners are committed to the protections in our Partnership the firm and we intend to enforce them.”

This ruling is of particular interest to all the firm partnerships since it affirms that the “restrictive covenant” in Weiser’s partnership mitchel musso is enforceable. “Bottom line is that client accounts are assets of the firm. You cannot sell a practice and then take it back while keeping what you jeanne tripplehorn paid. And, you cannot walk out the door with the firm’s property without paying for it, whether it’s a computer or a client,” concluded Weiser’s General Counsel, Scott Univer.
